Terms & Conditions

In these Terms, unless the context otherwise requires:

• "Company" means AffiliateNG Pvt Ltd, incorporated under the Companies Act, 2013.
• "Platform" means the website theaffiliatenexus.com and all associated mobile or web applications.
• "User" or "You" means any person accessing or using the Platform.
• "Affiliate Partner" means third-party e-commerce retailers (e.g., Amazon, Flipkart) whose products are listed on the Platform via affiliate links.
• "Affiliate Link" means a tracked URL directing Users to an Affiliate Partner's product page.
• "Content" means all text, images, product descriptions, reviews, logos, and other material on the Platform.
• "Services" means the affiliate product discovery, deal curation, search, and information services provided on the Platform.

• You must be at least 18 years of age or have the consent of a parent/guardian to use the Platform, as per the Indian Majority Act, 1875.
• By using the Platform, you represent that you have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872.
• Use of the Platform by entities requires authorisation by a duly authorised representative.
• These Terms are accepted upon: (a) accessing the Platform, (b) clicking "I Agree," or (c) submitting a contact form.

• All transactions are completed on the Affiliate Partner's website, and are governed exclusively by the Affiliate Partner's own Terms, Return Policy, and Privacy Policy.
• We act as an intermediary under the IT Act, 2000 (Section 2(w)) and the Consumer Protection (E-Commerce) Rules, 2020.
• Product prices, availability, and specifications are sourced from Affiliate Partners and may change without notice. We do not guarantee accuracy.
• We may earn a commission when you purchase via our Affiliate Links, at no additional cost to you.

As required by the Consumer Protection Act, 2019, Consumer Protection (E-Commerce) Rules, 2020, and ASCI Code for Self-Regulation, we disclose:

• AffiliateNG Pvt Ltd participates in the Amazon Associates Programme and other affiliate networks.
• We earn advertising fees when Users purchase products via our links.
• Our recommendations are editorially independent and based on product quality, ratings, and consumer value — not commission rates.
• We are not responsible for: (a) product quality or defects, (b) delivery or fulfilment, (c) refund or return processing, (d) pricing errors on partner sites.
• For any product complaints, warranty claims, or returns, contact the Affiliate Partner directly.

You agree not to:

• Use the Platform for any unlawful purpose or in violation of applicable Indian laws
• Attempt to scrape, crawl, or systematically extract Platform data without written permission
• Use automated tools to interact with the Platform in a manner that burdens our infrastructure
• Submit false, misleading, or defamatory content via the Contact form
• Attempt to manipulate affiliate tracking parameters or commit affiliate fraud
• Impersonate the Company, its employees, or any third party
• Engage in any conduct that violates the IT Act, 2000, IPC, or any other applicable statute

Violation may result in access termination and legal action under applicable Indian law.

• All Content on the Platform — including the AffiliateNG name, logo, design, text, and graphics — is owned by or licensed to AffiliateNG Pvt Ltd and is protected under the Copyright Act, 1957 and Trade Marks Act, 1999.
• You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for personal, non-commercial purposes only.
• You may not reproduce, distribute, modify, create derivative works, publicly display, or commercially exploit any Platform Content without our prior written consent.
• Product images and descriptions are property of respective Affiliate Partners and are used under licence.

To the fullest extent permitted by Indian law, the Company disclaims all warranties including:

• Merchantability or fitness for a particular purpose
• Accuracy, completeness, or currency of product information, prices, or availability
• Uninterrupted or error-free operation of the Platform
• The quality of products purchased from Affiliate Partners

To the maximum extent permitted under Indian law, AffiliateNG Pvt Ltd and its officers, directors, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, goodwill, or business opportunities
• Damages arising from products purchased via Affiliate Links
• Damages resulting from unauthorised access to your data due to third-party breaches

Our total aggregate liability for any direct damages shall not exceed INR 1,000 (One Thousand Rupees) or the amount paid to us (if any) in the preceding 3 months, whichever is lower.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or where restricted by the Consumer Protection Act, 2019.

You agree to indemnify, defend, and hold harmless AffiliateNG Pvt Ltd, its affiliates, directors, officers, and employees from and against any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:

• Your use or misuse of the Platform or Services
• Violation of these Terms or any applicable law
• Infringement of any third-party rights
• Fraudulent or false information submitted via the Platform

We reserve the right to, at our sole discretion and without prior notice:

• Suspend or terminate access to the Platform for any violation of these Terms
• Remove, edit, or disable any content or links on the Platform
• Discontinue all or part of the Platform's Services

Termination does not limit our right to pursue other remedies available under applicable Indian law.

• Governing Law: These Terms are governed by the laws of India, including the IT Act 2000, Consumer Protection Act 2019, and the Indian Contract Act 1872.
• Dispute Resolution:
  1. Negotiation: Parties shall attempt to resolve disputes amicably within 30 days.
  2. Arbitration: Disputes not resolved by negotiation shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996, with a sole arbitrator mutually appointed.
  3. Jurisdiction: Subject to arbitration, courts in India shall have exclusive jurisdiction.
• Consumer Grievances: Consumer disputes may also be addressed under the Consumer Protection Act, 2019 before the appropriate Consumer Forum.
• Language: These Terms are in English. In case of any conflict with a translated version, the English version shall prevail.

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Company.
• Severability: If any provision is found unenforceable, the remaining provisions continue in full force.
• Waiver: Failure to enforce any right does not constitute a waiver of that right.
• Amendments: We may update these Terms. Continued use after the effective date of changes constitutes acceptance. Material changes will be notified with at least 7 days' notice.
• Force Majeure: We shall not be liable for delays or failure to perform due to causes beyond our reasonable control.
